Pythoughts - Terms of Service

Thank you for using Pythoughts.com ("Pythoughts"). Our mission is to empower creators, thinkers, and learners by providing a modern platform for sharing blogs, ideas, discussions, and communities that matter.

These Terms of Service ("Terms") apply to your access to and use of the Pythoughts website, mobile experiences, creator tools, and any other online products or services we provide (collectively, the "Services"). By clicking "Continue," "Sign In," "Sign Up," or using any part of the Services, you agree to be bound by these Terms, including the dispute resolution provisions.

Our Privacy Policy explains how we collect and use your data, and our Community Rules explain expectations for user behavior. By using Pythoughts, you agree to comply with all of them.

1. Your Account and Responsibilities

You are responsible for the activity that occurs through your Pythoughts account and any content you create or publish.

  • You must comply with all applicable laws when using the Services.
  • Do not upload, post, or share content unless you have the legal right to do so.
  • Content on Pythoughts may be protected by intellectual property laws; respect those rights.
  • Your use of Pythoughts must comply with our Community Rules.

You may be required to create an account to access certain features. Please keep your login credentials secure and up to date. We recommend not sharing your password or account access with others.

If you are using Pythoughts on behalf of a company or organization, you represent that you have authority to do so. In that case, "you" and "your" refer to that entity.

You must be at least 13 years old to use Pythoughts.

Accessing Personal Information

If you access or process personal information of other Pythoughts users, you agree to:

  • Follow all applicable privacy and data protection laws
  • Not sell or misuse personal data
  • Collect and handle information lawfully and transparently

You represent that any personal data you provide to Pythoughts was lawfully collected and is permitted to be used by us as needed to operate the Services.


2. User Content on Pythoughts

You retain ownership of any content you create, publish, or display on Pythoughts.

Pythoughts may review user content to ensure compliance with our Terms and Rules and may remove or disable content that violates them.

Pythoughts may remove or disable content alleged to infringe intellectual property rights and may terminate accounts of repeated infringers. Copyright notices can be submitted according to our Copyright Policy.


3. Rights and License You Grant to Pythoughts

By posting, submitting, or displaying content on Pythoughts, you grant us a nonexclusive, royalty-free, worldwide, fully paid, sublicensable license to:

  • Use
  • Reproduce
  • Adapt
  • Modify
  • Publish
  • Translate
  • Distribute
  • Display
  • Create derivative works

This license allows us to operate and promote the Services—for example:

  • Showing your blog in feeds
  • Generating snippets or previews
  • Displaying your username and profile information with your post
  • Creating recommendation lists or collections that may include excerpts of your content

This license applies only within Pythoughts and its distribution channels. It does not grant us permission outside the Services.

As long as you comply with these Terms, Pythoughts grants you a limited, personal, non-exclusive, non-transferable license to use and access the Services.

We retain all rights to the platform, its design, software, branding, trademarks, and technology.

Feedback

If you submit ideas or suggestions, you agree that we may use them without obligation or compensation.

Pythoughts may change or discontinue parts of the Services at any time and may impose limits on use or storage.


4. Termination

You may stop using Pythoughts at any time.

We may suspend or terminate your access to the Services at our discretion, with or without notice, including if:

  • You violate these Terms
  • You disrupt the operation of the platform
  • We are required to do so by law

5. Data Processing and Transfers

By using Pythoughts, you agree that your information may be processed and stored in the United States and other countries, which may have different privacy protections from your own jurisdiction.


6. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Pythoughts and its officers, employees, partners, agents, and affiliates ("Pythoughts Parties") from any claims, damages, losses, or liabilities arising from:

  • Your violation of others' rights
  • Your violation of the law
  • Your misuse of the Services

You agree to cooperate with Pythoughts in defending such claims and acknowledge that Pythoughts retains the exclusive right to manage the defense or settlement.


7. Disclaimers - "As Is" Services

Pythoughts aims to provide a reliable platform but cannot guarantee perfect performance.

The Services are provided "as is" and "as available", without warranties of any kind, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability

We do not control and are not responsible for:

  • Third-party content
  • External links
  • Third-party integrations
  • User-generated content

You use the Services at your own risk.

Some jurisdictions do not allow certain disclaimers, so these limitations may not apply to you.


8. Limitation of Liability

To the fullest extent permitted by law, Pythoughts and the Pythoughts Parties are not liable for:

  • (a) Indirect, incidental, consequential, special, punitive, or exemplary damages
  • (b) Loss of profits, data, or business opportunities

Our total liability for any claim is limited to the greater of:

  • $50 USD, or
  • The amount you paid us, if any, for use of the Services

These limits do not apply where prohibited by law.


9. Resolving Disputes; Binding Arbitration

Before filing any legal claim, you must contact us at [email protected] and give us an opportunity to resolve the issue informally.

If we cannot resolve it within 30 days, either party may initiate arbitration.

Agreement to Arbitrate

You agree that certain disputes will be resolved through binding arbitration, not in court, and not through class actions.

Key Rules

  • No class actions or representative actions
  • Arbitration is confidential
  • Arbitration will be administered by JAMS under its Streamlined Arbitration Rules
  • Hearings occur in your state of residence (if you are a consumer) or in New York, NY (if not)
  • Either party may seek injunctive relief for IP violations

Opt-Out Option

You may opt out of arbitration within 30 days of first accepting these Terms by emailing: [email protected]

Your opt-out notice must include your full name, address, and a clear statement that you are opting out of arbitration.

If any part of the arbitration clause is unenforceable, the remainder stays in effect.


10. Governing Law and Venue

These Terms are governed by the laws of the State of New York, excluding its conflict-of-law principles.

Any dispute not subject to arbitration will be resolved exclusively in the state or federal courts located in New York, NY, unless local consumer protection laws require otherwise.


11. Amendments

We may update these Terms periodically. When we do, we will:

  • Update the "Last Updated" date
  • Notify you via email, platform notifications, or both

Updated Terms take effect immediately unless otherwise stated. If you do not agree to the updated Terms, you must discontinue using the Services.


12. Severability

If any portion of these Terms is found invalid or unenforceable, the remainder remains in full force.


13. Miscellaneous

  • Failure to enforce a right is not a waiver of that right.
  • Section titles are for convenience only.
  • These Terms constitute the entire agreement between you and Pythoughts.
  • The word "including" means "including without limitation."
  • Communications between us may be conducted electronically.
